The present General Conditions of use and contract, aim to regulate the commercial transactions that take place between the Owner (A&P Consulting SRL, C.F. 02369470204, P.IVA 02369470204, Via Don Arcangelo Tadini, 49 25125 Brescia BS) and the Users. The purchase of any of the products offered presupposes acceptance, without reservation of any kind, of each and every one of these general conditions of use.

The products presented on the Site comply with Italian law. Without prejudice to the case of fraud or gross negligence, the owner will not be liable for damages that may result from interference, omissions, interruptions, viruses, failures or disconnections in the operational functioning of this electronic system or in the equipment or computer equipment of users, motivated by causes external to the owner, which prevent or delay the provision of services in other electronic systems, nor the inability to give service or allow access for reasons not attributable to the owner due to the user, third parties, or force majeure.

In general, the User undertakes to comply with these general conditions of use and to always operate in accordance with the law, morality and the requirements of good faith, acting with due diligence and refraining from using the website in any way that may impede, damage or impair the normal operation of the same, the goods or rights of the Owner, its suppliers, and the rest of the users or third parties in general.

The Owner reserves the right at any time and unilaterally to change the price of products and services offered through its web page. The owner in any case guarantees the customer that the price indicated at the time of formalization of the order will not be subject to subsequent changes. To proceed with an order it is necessary to connect to the Site, select the desired product and then fill out the electronic form, following the instructions indicated in the same.

The form of payment is by Credit Card (Mastercard, Visa, American Expres, Diners Club), bank transfer or Paypal. In the event that the TPV communicates the rejection of the card, it will automatically cancel the purchase order, informing the customer online of this cancellation. Similarly, in case of non-receipt of the transfer after 5 working days from the registration of the order, will automatically cancel the purchase order, informing the customer online of this cancellation. For payments made with foreign cards, it is necessary that the bank that issued them respects the Security Protocol of Secure Electronic Commerce (CES). Payments with cards that do not have this requirement are not allowed. The communication that the user will receive by email once the purchase is confirmed is valid as proof of purchase and for the purposes of the manufacturer's warranty. Notwithstanding this, an invoice may be requested, during and not beyond the purchase process, indicating the data that will be required for the issuance of the same. The User acknowledges and expressly accepts that once the purchase process has been completed, it will not be possible to request the issue of an invoice.

Pursuant to and for the purposes of art. 52 of the Consumer Code, the User has the right to withdraw from the contract within 14 days of enrollment and provided that he/she has not, before this deadline, received the credentials for access to the e-learning platform and/or has not read the course material of the chosen course. In order to exercise the right of withdrawal, the User must inform the Owner of his decision to withdraw from this contract by means of an explicit declaration sent by email to [email protected]. In order to comply with the withdrawal period, it is sufficient for the User to send the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period. If the User withdraws from this contract, the Controller will refund the User all payments that the User has made to the Controller, without undue delay and in any case no later than 14 days from the day on which the Controller was informed of the User's decision to withdraw from this contract. Said refunds will be made using the same means of payment used by the User for the initial transaction, unless the User has expressly agreed otherwise; in any case, the Controller guarantees that the User will not incur any costs as a result of said refund.v

The consumer residing in Europe should be aware that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by the European consumer to resolve in a non-judicial way any dispute relating to and / or arising from contracts for the sale of goods and services concluded online. Consequently, if the User is a European citizen, he/she can use this platform to resolve any dispute arising from the online contract entered into with the Owner.
