Who is obliged to draw up the work-related stress assessment document?
The work-related stress risk assessment is a legal obligation of the employer and is an integral part of the DVR, a document that represents the mapping of health and safety risks present in a company. In all companies, the assessment covers all risks to workers' health and safety, including those concerning groups of workers exposed to particular risks.

Sanctions
The work-related stress assessment document may be requested during inspections by ASL technicians or labour inspectors. In the event of non-compilation, the sanctions that the employer may incur are those provided for in Article 17, paragraph 1, letter A. and range from a minimum of 2,457 to a maximum of 4,914 euros.

Work-related stress is one of the most common work-related illnesses: it may be caused by the way work is organised or by the tasks that have to be performed and that may overload the worker in question.

What is work-related stress

This malaise affects the company, giving rise to a number of organisational and other problems, for example:

  • Decline in productivity; 
  • Absenteeism; 
  • Increase in accidents; 
  • Tendency to make mistakes or fall into carelessness.

The definition of work-related stress according to the European Framework Agreement of 2004: "A condition that may be accompanied by disturbances or dysfunctions of a physical, psychological or social nature and is a consequence of the fact that certain individuals do not feel able to meet the demands or expectations placed on them".

Work-related stress, being caused by various aspects of work organisation and environment, can affect any workplace and any worker. Work-related stress is not a disease, but if it manifests itself intensely and over time, it can cause mental and physical health problems.

In 2011 the Department of Medicine, Epidemiology, Occupational and Environmental Hygiene published a methodology for the assessment and management of work-related stress risk, updated in 2017. This methodology was created to support companies in the assessment of work-related stress risk, pursuant to Legislative Decree 81/2008 as amended and supplemented, on the basis of a scientifically proven methodological pathway and valid and reliable assessment tools.

Drafting of the work-related stress risk assessment document

By means of a checklist, to be filled in with all the information that characterises the company, some stress risk indicators of the last three years will be collected. This document, once completed, should be sent to the email address: [email protected] attaching the company's Chamber of Commerce certificate. The assessment of work-related stress is essentially carried out in two stages:

  • Preliminary assessment: if the preliminary assessment does not reveal elements of work-related stress risk such as to require recourse to corrective action, the employer will only be required to report it in the Risk Assessment Document (DVR) and to provide a monitoring plan. 
  • In-depth assessment: if elements of risk from work-related stress are found that require corrective action, appropriate corrective measures are planned and adopted, such as organisational, technical, procedural, communication, training, etc. interventions. Should the corrective actions prove ineffective, a subsequent assessment of each worker by specialised personnel is carried out within the timeframe defined by the company itself in the action planning.
